Terms of Service

These Terms of Service ("Terms") govern your use of QuizMachine ("Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using QuizMachine you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@quizmachine.io if you suspect unauthorised access.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Distribute spam, malware, or other harmful content.
• Collect personal data from respondents without appropriate disclosure and consent.
• Impersonate another person or entity.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Create quizzes that contain illegal, defamatory, or discriminatory content.

4. Your Content

You retain ownership of any content you create (quizzes, questions, responses). By uploading content to QuizMachine you grant us a limited, non-exclusive licence to store and display it solely for the purpose of providing the Service to you. We do not claim ownership of your content and will not use it for any other purpose.

5. Intellectual Property

The QuizMachine name, logo, and underlying software are our intellectual property. You may not copy, modify, or distribute them without our prior written consent.

6. Free Tier Limits

The free tier is subject to usage limits as described on our Pricing page. We reserve the right to adjust these limits with reasonable notice.

7. Purchases and Renewal

Paid plans are sold through Lemon Squeezy as merchant of record. Lemon Squeezy takes the payment, adds any sales tax or VAT and issues the receipt. Prices are shown in USD on the Pricing page. A plan purchase covers the fixed period shown at checkout (one month or one year) and does not renew automatically. Buying the same plan again adds a new period after the current one ends; buying a different plan replaces the current plan immediately. Without one, the account returns to the Free plan, and content above the Free limits is closed, not deleted.

8. Refunds and Cancellation

Plan purchases do not renew, so there is nothing to cancel: access ends with the paid period. These Terms do not limit your statutory rights, such as a right of withdrawal or remedies for a defective service. We refund duplicate or incorrect charges in full, and we may give one goodwill refund for a first plan purchase requested within 14 days. Request refunds at hello@quizmachine.io. Refunds go to the original payment method. A full refund ends the plan at once; a partial refund leaves it unchanged. If you dispute a charge with your bank, access continues while the dispute is open.

9. Selling Quizzes and Packages

Trainers sell quizzes and packages through their own connected Stripe account and are the seller of each sale. The trainer sets the price and is responsible for the content, taxes, receipts, refunds and the buyer's statutory rights. Refunds, disputes and Stripe fees are charged to the trainer's account. QuizMachine may charge a platform fee, which is shown before an item is published. Some passes renew automatically until canceled; this is shown before purchase. If a card dispute is decided in the buyer's favour, access to that purchase ends.

10. AI Features

AI features such as question generation and AI grading use the AI provider and API key that you or your organisation configure. Content sent to them, such as questions, answers and uploaded images, is processed by that provider under its own terms, and the provider bills you directly. AI output can be wrong, so review AI grades and generated content before relying on them.

11. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to other users or to the Service. You may delete your account at any time via the account settings page.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

13. Limitation of Liability

To the maximum extent permitted by law, Cove Code LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

14. Governing Law

These Terms are governed by the laws of Norway, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Norway.

15. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes by email or in-app notice. Continued use of the Service after the effective date of revised Terms constitutes acceptance.
